TERMS & CONDITIONS

1.               THE PROMOTER AND OPERATOR

The promoter and operator is: YMU Group (UK) Limited (“Operator”) c/o YMU Group, 180 Great Portland Street, W1W 5QZ London.

2.                        THE PRIZE DRAW

2.1                     The title of the prize draw is ‘Sara Davies x Feeling Fabulous Competition’ and is operated by the Operator.

2.2                     Participation in the prize draw will offer the chance for 1 eligible entrant to win 1 x Pair of Saturday PM tickets, meet with Sara, take part in her crafting workshop, glass of fizz, goody bag and signed copy of book. 5 eligible entrants to win one pair of general admission tickets for Ruth Langsford’s Feeling Fabulous Event at Old Billingsgate, London at a session time of choice.

3.                        HOW TO ENTER

3.1                     The prize draw will run from 00:01 Thursday 30th June 2022] (the “Opening Date”) to 23:59 Thursday 7th July 2022 (the “Closing Date”) inclusive.

3.2                    All entries must be received by the Operator via the website feelingfabulous.com/competitions by no later than 5 pm on the Closing Date. All entries received after the Closing Date are automatically disqualified. 

3.3                     No purchase necessary.

3.4                     The Operator will not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.5                     By submitting an entry, you are agreeing to be bound by these terms and conditions.

3.6                     For help with entries, please email sarah.parker@ymugroup.com including ‘COMPETITION ASSISTANCE’ in the subject title of your email. 

4.                        ELIGIBILITY

4.1                     The prize draw is only open to all residents in the UK and Republic of Ireland aged over 18 years, with internet access except:

4.1.1                employees of the Operator

4.1.2                employees of agents or suppliers of the Operator

4.1.3                members of the immediate families or households of those within condition 4.1.1  and 4.1.2 above.

4.2                     In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize. The Operator may require you to provide proof that you are eligible to enter the prize draw.

4.3                     The Operator will not accept prize draw entries that are:

4.3.1                automatically generated by computer;

4.3.2                completed by third parties or in bulk;

4.3.3                illegible, have been altered, reconstructed, forged or tampered with;

4.3.4                photocopies and not originals; or

4.3.5                incomplete.

4.4                     Each individual can only make one entry. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5                     Each valid entry will be entered into a draw and the winners will be selected at random by a computer process operated by Operator.  

4.6                     The Operator reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

5.                        THE PRIZE

5.1                     There are two prizes to win, being:

5.1.1                1 x Pair of Saturday AM tickets to Ruth Langsford’s Feeling Fabulous event at Old Billingsgate; meet with Sara Davies; glass of prosecco or alternative; goody bag and signed copy of Sara Davies’ book.

5.1.2       5 x pairs of general admission tickets for Ruth Langsford’s Feeling Fabulous Event at Old Billingsgate, London. There is no cash alternative for the prize.

5.2                     The prize is not negotiable or transferable.

5.3                     Travel and/or accommodation to/from the venue are not included.

5.4                     The Operator shall be entitled to substitute the whole or a part of the prize for an alternative prize or prizes including substituting at its reasonable discretion should circumstances beyond its control arise. 

6.                        WINNERS

6.1                     The decision of the Operator is final and no correspondence or discussion will be entered into with any entrant or winner except where permitted or undertaken by Operator.

6.2                     The Operator will contact the winner personally as soon as practicable after the Announcement Date, using Instagram’s direct message function to the Instagram account associated with the prize draw entry. In order to claim your prize, you will need to respond to the direct message. 

6.3                     The Operator must either publish or make available information that indicates that a valid prize winner was selected and valid prize award took place. To comply with this obligation the Operator will share the first name and county of the winner via the @saradaviescc Instagram channel by Friday 8th July 20222 (“Announcement Date”). This announcement may also be shared via any of the Operator’s other social media channels and websites.

6.4                     If you object to any or all of your name, county and winning entry being published or made available, please contact the Operator via the direct message the Operator contacted you through on Instagram, prior to the Announcement Date. 

7.                        CLAIMING THE PRIZE

7.1                     If you are the winner of the prize, you will have seven days from the Announcement Date to claim the prize by replying to the Instagram direct message or email that the Operator contacted you through. If you do not claim the prize by this date, your claim will become invalid.

7.2                     The prize may not be claimed by a third party on your behalf.

7.3                     The Operator will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 7 days of the Announcement Date, the Operator reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4                     The Operator do not accept any responsibility if you are not able to take up the prize.

8.                        LIMITATION OF LIABILITY

Insofar as is permitted by law, the Operator, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Operator, its agents or distributors or that of their employees. Your statutory rights are not affected.

9.                        OWNERSHIP OF PRIZE DRAW ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

9.1                     All prize draw entries and any accompanying material submitted to the Operator will become the property of the Operator on receipt and will not be returned.

9.2                     By submitting your prize draw entry and any accompanying material, you agree to:

9.2.1                assign to the Operator all your intellectual property rights with full title guarantee; and

9.2.2                waive all moral rights,

in and to your prize draw entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

9.3                     You agree that the Operator may, but are not required to, make your entry available on its website or other website it nominates, its social media channels and any other media, whether now known or invented in the future, and in connection with any publicity of the prize draw. You agree to grant the Operator a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the prize draw entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the prize draw entry and any accompanying materials for such purposes.

10.                     DATA PROTECTION AND PUBLICITY

10.1                  The Operator will process entrants’ data in accordance with their Privacy Policy which can be found via the following link: https://feelingfabulouswithruth.com/privacy-policy

10.2                  The Operator will only receive data from the winning entrants being: the entrant’s name, email and county of residence which shall be used in accordance: (a) with condition 6.3, condition 6.4, and condition 9.3 with regard to the announcement of winners; (b) with condition 7.1 in order to administer the prize and (c) for its internal business purposes and legal and regulatory compliance purposes. The data may be shared with third parties for the sole purposes of assisting with (a), (b) and (c). 

10.3                  If you object to any part or all of your name, county and winning entry being published, used or made available in accordance with condition 10.2, please contact the Operator via Instagram account @saradaviescc or email sarah.parker@ymugroup.com.

11.                     GENERAL

11.1                  If there is any reason to believe that there has been a breach of these terms and conditions, the Operator may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.

11.2                  The Operator reserves the right to hold void, suspend, cancel, or amend the terms and conditions of this prize draw at any time where it deems it necessary to do so.

11.3                  These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
